By accessing and using the GMART service ("Service"), you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our services.
2. Service Description
GMART is a hyperlocal delivery platform that connects users with local shopkeepers for fast delivery of products. We are not responsible for the quality, legality, or authenticity of items sold by our shopkeeper partners.
3. User Eligibility
You must be at least 18 years old and a resident of a service area to use GMART. By using our service, you represent that you meet these requirements and have the authority to enter into this agreement.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities under your account. You agree to:
- Provide accurate and complete information during registration
- Update your information promptly if it changes
- Notify us immediately of unauthorized access
- Use the service only for lawful purposes
5. Orders and Payment
When you place an order through GMART:
- Prices include applicable taxes and delivery charges
- Payment is processed securely through our payment gateway
- Orders can be cancelled within 60 seconds of placement
- Prices are subject to change without notice
- We reserve the right to refuse or cancel any order
6. Delivery Terms
GMART commits to delivering orders within 10 minutes from the time they are confirmed:
- Delivery availability depends on your location and item availability
- You must be present at the delivery address at the time of delivery
- If an item is out of stock, we will notify you and offer alternatives
- We are not liable for items damaged after delivery
- Delivery times may vary due to unforeseen circumstances
7. Product Liability
GMART is a platform that connects you with local shopkeepers. We are not liable for:
- Quality or condition of items sold
- Injuries or damages caused by products
- Allergic reactions to items ordered
- Missing or incomplete items (subject to refund policy)
- Expired or damaged goods upon delivery

8. Prohibited Uses
You agree not to:
- Place orders for illegal items or substances
- Provide false information or impersonate others
- Engage in fraudulent activity or chargebacks
- Harass or threaten shopkeepers or delivery personnel
- Attempt to bypass payment or delivery systems
- Share your account with others
- Use automated tools to access the service
- Violate any applicable laws or regulations
9. Intellectual Property
The GMART platform, including all content, designs, and features, is the exclusive property of GMART. You may not reproduce, distribute, or use any part of our service without permission. GMART® is a registered trademark.
10. Limitation of Liability
To the maximum extent permitted by law, GMART is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of our service.
11. Indemnification
You agree to indemnify and hold GMART harmless from any claims, damages, or expenses (including legal fees) arising from your use of the service or violation of these terms.
12. Termination
We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason. Upon termination, your right to use the service ends immediately.
13. Changes to Terms
We may modify these Terms of Service at any time. Continued use of our service following notification of changes constitutes your acceptance of the new terms.
14. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes shall be resolved under Indian law.
